Get4th · get4th.com · Effective August 28, 2026 · Version 2026-08-28

Plain-English summary (the Terms below control): Get4th is a tool that sends text messages on your behalf to people you add. You are the sender. You promise you have each person's permission before they're texted, you never upload purchased or scraped lists, and you are responsible for complying with texting laws. Get4th is provided as-is, our liability is capped, you indemnify us for claims caused by your use, and disputes go to individual arbitration, not court or class actions. If you don't agree, don't create an account.

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you — the person or organization creating an organiser account ("you", "Organiser") — and CAN TECH CORP, a Massachusetts corporation doing business as Get4th ("Get4th", "we", "us"), governing your use of the Get4th service at get4th.com, its applications, messaging features, APIs and related services (the "Service"). By creating an account, ticking the acceptance box, accessing or using the Service, you accept these Terms and our Privacy Notice. If you use the Service on behalf of a club, facility, league or other organization, you represent that you have authority to bind it, and "you" includes that organization.

2. Definitions

3. You are the sender

Get4th is a software tool. Every Message sent through your account is sent by you, at your direction, to people you chose. Get4th does not select recipients, does not initiate contact with anyone you did not add, and acts solely as your service provider in transmitting Messages. You are the "sender," "initiator," and "caller" of all Messages for purposes of the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the CTIA Messaging Principles and Best Practices, state telemarketing and privacy laws, and any similar law anywhere your Players are located (together, "Messaging Laws").

4. Consent: your warranties and obligations

You represent, warrant and covenant that, for every Player whose number you add or import by any method (manual entry, phone-contact import, file upload, API, or otherwise):

  1. Prior permission. The Player personally gave you their mobile number and agreed to receive text messages from you about games and related activity, before you added them.
  2. No purchased, rented, scraped or shared lists. The number was not obtained from a purchased or rented list, a public directory, a website, a data broker, another club's roster without that Player's agreement, or any source other than the Player themselves.
  3. Confirmation is honored. You understand the Service sends at most one consent confirmation text to a Player without recorded consent, solely to confirm the permission you attest to above. You will not attempt to contact a Player who does not confirm, who declines, or who texts STOP, through the Service, through any other number, or by any workaround.
  4. Attestations are true. Every attestation you make in the Service (including the permission checkbox on adding or importing Players and the bulk-upload attestation) is true, complete and made with personal knowledge, and you will keep records sufficient to prove each Player's consent for at least four (4) years.
  5. Accurate identity. Messages will accurately identify you or your club as the sender, and you will not use the Service to impersonate any person or organization.
  6. Eligible recipients. You will not add numbers belonging to minors under 13, numbers on any internal do-not-contact list you maintain, or numbers you know or should know to be reassigned, wireless-ported, or otherwise not the Player's.
  7. Lawful content and purpose. Messages will concern the games, events and related logistics of your group only. No marketing of third-party goods or services, no political, charitable-solicitation, lending, cannabis, gambling, adult, or other content prohibited by carriers or the CTIA, and nothing unlawful, harassing, deceptive or infringing.

You are solely responsible for obtaining and documenting consent. Get4th records the consent signals it observes (form acceptances, replies, taps) as a convenience to you; those records are not legal advice and do not replace your obligation to have and prove consent.

5. Messaging rules

5A. SMS program terms (for Players)

Program: Get4th game notifications. When your organiser or club adds you, Get4th sends text messages about pickleball games on their behalf: invitations, confirmations, reminders, waitlist updates, cancellations and replies to questions you ask.

6. Players are not our customers

Players do not create accounts with Get4th and have no contract with us. Your relationship with your Players is yours. You are responsible for what you tell them, for honoring their requests, and for resolving their complaints. If a Player or regulator makes a claim relating to Messages sent through your account, Section 12 (Indemnification) applies.

6A. Email communications

Organisers: a valid email address is required to open and keep an organiser account, and it must be verified through the link we send. By accepting these Terms you agree that we may use that address for service and account messages (verification, security, billing, changes to these Terms) and for program updates, announcements and marketing about Get4th. You can unsubscribe from marketing email at any time using the link in any such message or from Settings; service and account messages continue while you hold an account.

Players: providing an email is optional. If a Player gives us one and asks to stay up to date, we may send product updates and announcements to it until they unsubscribe. We do not sell email addresses and do not share them with third parties for their own marketing.

7. Accounts and security

You must provide accurate information, keep your credentials confidential, enable available security features as appropriate, and notify us promptly of any unauthorized use. You are responsible for all activity under your account, including activity by anyone you give access to and by any API key, integration or AI agent you connect. One person may hold one organiser account per mobile number. We may suspend or terminate accounts that violate these Terms, create deliverability risk, or receive complaints, with or without notice.

8. Plans, fees and billing

Plan features, limits and prices are as stated on get4th.com at the time of purchase and may change on notice; changes apply at your next billing period. Paid plans renew automatically until cancelled. Fees are non-refundable except where required by law. Usage beyond included message volumes is billed at the published rate. We may suspend the Service for non-payment. Taxes are your responsibility. You authorize us and our payment processor to charge your payment method for all amounts due.

9. AI features

The Service uses automated and AI systems to read Player replies, classify them, draft messages for your approval, answer Player questions from game data, and suggest who to invite. These systems can be wrong. You are responsible for reviewing anything sent in your name and for every roster, scheduling and scoring decision. Player messages and game context are processed by third-party AI providers under contractual confidentiality; they are not used to train those providers' models. AI output is not advice and is provided without warranty.

Assistant conversations are saved. When you talk or type to an assistant feature (such as "Fourth"), your side of the conversation, the assistant's responses, and the resulting drafts are stored with your account. We use this history to operate the feature (including remembering your preferences and context between sessions) and we may review and use it to improve the Service — for example to fix misunderstandings, tune prompts, and develop features. We do not use it to train third-party AI providers' models, we do not sell it, and we do not share it outside our processors described in Section 10. You can ask us to delete your assistant history at any time at support@get4th.com.

10. Third-party services

The Service interoperates with telecommunications carriers, messaging providers, payment processors, rating services (such as DUPR) and AI providers. Their services are governed by their own terms, may change or become unavailable, and are not warranted by Get4th. Features marked "working on it," "beta," "preview" or similar may be incomplete, may change or be withdrawn at any time, and are provided without any obligation.

11. Your Data; intellectual property

You retain ownership of Your Data and grant Get4th a worldwide, non-exclusive, royalty-free license to host, process, transmit, display and create derivative works of Your Data solely to provide, secure, support and improve the Service. You warrant you have all rights needed to grant that license, including as to Players' personal information. The Service, its software, designs, marks and content are owned by Get4th and its licensors; you receive only a limited, revocable, non-transferable right to use the Service under these Terms. You will not copy, modify, reverse engineer, scrape, resell, white-label (except under a plan that includes it), or build a competing product using the Service. Feedback you give us may be used freely.

12. Indemnification

You will defend, indemnify and hold harmless Get4th, CAN TECH CORP, and their officers, directors, employees, contractors, providers and agents from and against all claims, demands, suits, investigations, fines, penalties, damages, settlements, costs and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) any Message sent through your account; (b) any actual or alleged violation of Messaging Laws, carrier or CTIA rules, or any other law by you or relating to your Players; (c) any breach of Section 4 (Consent) or any attestation you made; (d) Your Data, including any claim that it was collected or used without authorization; (e) your Players' claims of any kind; (f) your use of AI features, API keys or integrations; and (g) your breach of these Terms. Without limiting the foregoing, you acknowledge that TCPA claims may carry statutory damages of $500 to $1,500 per Message and that you bear that risk entirely. We may control the defense of any matter at your expense, and you will not settle any claim that imposes obligations on us without our written consent.

13. Disclaimers

The Service is provided "as is" and "as available," with all faults, and without warranty of any kind, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. Get4th does not warrant that any Message will be sent, delivered, read, or acted on; that games will fill; that consent records will satisfy any legal standard; that AI output is correct; or that the Service is suitable for your legal compliance needs. You use the Service at your own risk. No advice or information from Get4th creates a warranty. Get4th does not provide legal advice.

14. Limitation of liability

To the fullest extent permitted by law: (a) Get4th and its affiliates, officers, directors, employees, contractors, providers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunity, or for the cost of substitute services, however caused and under any theory, even if advised of the possibility; and (b) the total aggregate liability of Get4th for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the fees you paid to Get4th in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars ($100). These limits apply regardless of the form of action and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted.

15. Dispute resolution; arbitration; class-action waiver

Please read carefully — this affects your rights.

  1. Informal resolution first. Before filing any claim, you will send written notice to legal@get4th.com describing the dispute, and both parties will attempt in good faith to resolve it for sixty (60) days.
  2. Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be finally resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer or Commercial Arbitration Rules (as applicable), before a single arbitrator, in Middlesex County, Massachusetts, or by video conference. The Federal Arbitration Act governs this section. The arbitrator may award the same relief a court could award to the individual party, but no relief affecting other users.
  3. Class-action and jury-trial waiver. You and Get4th each waive the right to a trial by jury and the right to participate in a class, collective, representative or consolidated action or arbitration. If this waiver is found unenforceable as to a particular claim, that claim will proceed in court, not arbitration, and will be stayed pending arbitration of all other claims.
  4. Exceptions. Either party may bring an individual claim in small-claims court, or seek injunctive relief in court to protect intellectual property or to stop misuse of the Service that threatens deliverability or other users.
  5. Opt-out. You may opt out of arbitration by emailing legal@get4th.com within thirty (30) days of first accepting these Terms, with your account number and a clear statement that you opt out. Opting out does not affect the class-action waiver or any other term.

16. Governing law; venue; time limit

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 15, the state and federal courts located in Middlesex County, Massachusetts have exclusive jurisdiction, and you consent to personal jurisdiction there. Any claim against Get4th must be brought within one (1) year after it arises, or it is permanently barred.

17. Suspension and termination

You may close your account at any time in Settings. We may suspend or terminate your account or any feature immediately if we believe you have breached these Terms, created legal or deliverability risk, failed to pay, or if required by a carrier, provider or law. On termination your right to use the Service ends; we may retain Your Data and consent records as required by law or for legitimate business purposes (including defending claims) and will otherwise delete or de-identify it in the ordinary course. Sections 3, 4, 6, 11, 12, 13, 14, 15, 16, 17 and 19 survive termination.

18. Changes

We may modify these Terms. Material changes will be posted at get4th.com/terms with a new version date and, where practical, notified through the Service or by email at least fourteen (14) days before taking effect. Continued use after the effective date is acceptance. Changes to the arbitration provisions do not apply to disputes already noticed under Section 15.

19. General

These Terms and the Privacy Notice are the entire agreement between you and Get4th regarding the Service and supersede all prior agreements. You may not assign these Terms without our consent. We may assign or transfer these Terms, and all rights and obligations under them, without your consent to any affiliate or to any successor in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of our assets or of the business to which the Service relates. In such an event your account, your roster and contact records, message history, and all consents and attestations recorded through the Service transfer to the successor, who may continue to operate the Service and send messages under the same consents; the successor will honour these Terms and the Privacy Notice (or terms at least as protective) and we or the successor will notify you of the transfer by text, email, or a notice in the Service. Opt-outs (STOP) and consent withdrawals remain effective against the successor. No waiver is effective unless in writing. If any provision is unenforceable it will be limited to the minimum extent necessary and the remainder stays in effect. Neither party is liable for delays caused by events beyond its reasonable control, including carrier outages. Notices to you may be sent to the mobile number or email on your account; notices to us go to legal@get4th.com or CAN TECH CORP, Massachusetts, USA. Nothing creates a partnership, agency or employment relationship. You will comply with export and sanctions laws. The Service is controlled from the United States and intended for use by organisers in the United States.
